GYM TERMS AND CONDITIONS
Elite Altitude Training Center
1. Acceptance of Terms
By accessing or using the facilities, services, or website of Elite Altitude Training Center (“Club,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions.
2. Membership Eligibility
- Members must be 14 years or older.
- Members under 18 must have a parent or legal guardian sign all required agreements, including liability waivers.
- The Club reserves the right to refuse or terminate membership to the extent permitted by applicable law.
3. Membership Terms
- Memberships are non-transferable.
- Membership fees and terms are subject to change with reasonable notice.
- By enrolling, you authorize recurring billing as outlined below.
4. Billing & Automatic Renewal (California ARL Compliance)
- Memberships are billed on a recurring monthly basis unless canceled.
- By signing up, you authorize the Club to charge your provided payment method automatically each billing cycle.
- You may cancel at any time through your online account or by contacting us at: contact@elitealtitude.com
- Cancellations must be submitted at least 30 days prior to the next billing date to avoid the next charge.
- You will receive confirmation of your cancellation request.
5. Refund Policy
- Membership fees are generally non-refundable, except where required by law.
- Refunds, if any, are issued at the sole discretion of the Club or in cases required under California law (e.g., billing errors).
6. Facility Access
- Valid membership is required for entry.
- The Club may suspend access for unpaid balances.
- Members must comply with all posted rules and staff instructions.
7. Assumption of Risk & Liability Waiver (IMPORTANT)
By using the Club’s facilities, you acknowledge and agree that:
- Physical exercise involves inherent risks, including but not limited to serious injury, illness, or death.
- You voluntarily assume all risks associated with participation.
- To the fullest extent permitted by California law, you release and hold harmless the Club, its owners, employees, contractors, and agents from any liability for injuries, damages, or losses arising from your use of the facilities, including those resulting from ordinary negligence.
8. Health & Safety
- You are responsible for ensuring you are physically and medically able to participate.
- Stop exercising immediately if you feel pain, dizziness, or discomfort.
- Members must follow all hygiene and safety rules, including wiping down equipment.
9. Personal Property
- Lockers are provided for temporary use only.
- The Club is not responsible for lost, stolen, or damaged items, to the fullest extent permitted by law.
10. Conduct
- Members must behave respectfully and safely at all times.
- The Club reserves the right to suspend or terminate membership for rule violations or unsafe behavior.
11. Facility Maintenance & Availability
- The Club may temporarily close areas for maintenance or other operational needs.
- No refunds or credits will be issued for temporary closures unless required by law.
12. Non-Discrimination
The Club operates in compliance with applicable federal and California anti-discrimination laws and does not discriminate on legally protected grounds.
13. Website Use
- All website content is for personal, non-commercial use only.
- Unauthorized use, copying, or interference with the website is prohibited.
14. Limitation of Liability
To the fullest extent permitted by law, the Club shall not be liable for indirect, incidental, or consequential damages arising from use of its services or facilities.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of California.
16. Severability
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Changes to Terms
The Club may update these Terms at any time. Continued use of the facilities constitutes acceptance of the updated Terms.
